In yet another victory for Republican presidential nominee Donald Trump, U.S. District Court Judge Aileen Cannon tossed the former president’s classified documents case, ruling that the appointment of Special Counsel Jack Smith, whom Trump himself called a criminal, was unconstitutional.
Smith’s position “effectively usurps that important legislative authority, transferring it to a Head of Department, and in the process threatening the structural liberty inherent in the separation of powers,” Judge Cannon wrote in her decision.
“He can be appointed and confirmed through the default method prescribed in the Appointments Clause, as Congress has directed for United States Attorneys throughout American history. Dismissal of this action is the only appropriate solution for the Appointments Clause violation.”

Judge Cannon’s sudden ruling in the case came after the judge indefinitely postponed Trump’s trial following a May hearing in which the former president and co-defendant Walt Nauta argued that the Department of Justice’s (DOJ) decision to prosecute the valet was “both selective and vindictive” against Trump.
As he usually does, Trump took to social media, in this case his private Truth Social platform, to celebrate Judge Cannon’s decision to drop the case and clear his path towards the presidency.
“As we move forward in Uniting our Nation after the horrific events on Saturday, this dismissal of the Lawless Indictment in Florida should be just the first step, followed quickly by the dismissal of ALL the Witch Hunts,” Trump wrote.
“The Democrat Justice Department coordinated ALL of these Political Attacks, which are an Election Interference conspiracy against Joe Biden’s Political Opponent, ME. Let us come together to END all Weaponization of our Justice System, and Make America Great Again!”
Not long after Judge Cannon issued her decision, Trump announced Sen. J.D. Vance (R-Ohio) as his vice presidential pick, Vance being both a millennial and a serviceman.
It really has been nothing but victory after victory for Trump ever since the Supreme Court ruled on July 1 that the former president has immunity from prosecution for many of his actions while in the White House. This latest ruling by Judge Cannon is no exception.
“The dismissal of the classified documents case is a seismic development,” tweeted legal analyst and academic Jonathan Turley. “From the beginning of all of these cases, I have said that the Mar-a-Lago case was the greatest threat to the former president. It is now dismissed.”
Prosecutors will almost certainly appeal Judge Cannon’s ruling. They will more than likely try to argue that other cases have repeatedly upheld the ability of the DOJ to appoint special counsels for politically sensitive investigations.
“Smith needs any legal qualification ripped up as a minimum but jailed for perverting the course of justice,” one commenter wrote about the matter. “He knew what he was doing and was handsomely paid to do it, costing taxpayers millions to bring the case. All a fraud.”
“Trump is now a lock,” wrote another. “Just how determined will the deep state be to finish the job? My guess is the alternatives are now heading to the top of the list, major false flag, nukes come to mind. Anything less, like another fake pandemic, just won’t cut it.”
