The Biden camp has been scrambling to hold onto Joe’s chances of reelection following his humiliating debate performance, and that desperation can be clearly seen in the way the president is reacting to the Supreme Court’s recent ruling about presidential immunity.
In a sad, last-ditch effort to rally up support and distract from his obvious cognitive struggles, Biden has resorted to some very divisive rhetoric about the ruling that former presidents can have immunity from criminal prosecution for any conduct that involves official acts while they are in office. The ruling means that although Trump is not immune to prosecution for unofficial acts, he is highly unlikely to go to trial in his classified documents case before the election – posing yet another threat to Biden’s already dwindling hopes of another four years in the White House.
In polarizing remarks that were clearly read off a teleprompter, Biden accused the Supreme Court of a “terrible disservice to the people of this nation,” intentionally mischaracterizing their ruling in civil war-style talk that one can only hope won’t lead to dangerous civil unrest. He conveniently failed to mention that there is no immunity for unofficial acts, and he also left out the part where the Supreme Court explicitly stated that “the president is not above the law.”
Instead, he attacked the Supreme Court for “gutting voting rights and civil rights, taking away a woman’s right to choose, and today’s decision that undermines the rule of law of this nation.” Abortion had nothing to do with the new ruling, but since it’s such a hot-button topic that tends to bring out strong emotions, his speechwriters didn’t want to miss this opportunity to add fuel to the fire.
This does not mean that Trump will not be held accountable for any of the charges he is facing. It is now up to the lower courts to decide if Trump’s alleged interference in the 2020 presidential election is an “official act” or not as the Supreme Court did not decide that question, but Biden wants the American people to believe that he can now get away with anything he wants.
He falsely painted the ruling as meaning that “there are virtually no limits on what a president can do” and said he agreed with Justice Sonia Sotomayor’s dissent, repeating her claim that “the president is now a king above the law” and that she has “fear for our democracy.”
The president told another lie when he said that his “predecessor sent a violent mob to the U.S. Capitol to stop the peaceful transfer of power” – and we probably won’t see any mainstream news organizations issuing fact checks on this claim despite Trump’s post on X on January 6, 2021, in which he clearly stated: “I am asking for everyone at the U.S. Capitol to remain peaceful. No violence! Remember, WE are the Party of Law & Order – respect the Law and our great men and women in Blue. Thank you!”
Since the Supreme Court ruling didn’t go his way and many in his own party have lost all confidence in him, Biden called on Americans to settle the score.
“So now the American people have to do what the court should have been willing to do, but will not. The American people have to render a judgment about Donald Trump’s behavior. The American people must decide whether Donald Trump’s assault on our democracy on January 6 makes them unfit for public office in the highest office in the land,” he said.
After making his outlandish claims and clearly trying to pit Americans against each other in his four-minute speech, Biden walked away from the teleprompters before reporters had a chance to ask him any questions and embarrass himself yet again.
Constitutional law expert Jonathan Turley accused Biden of being misleading, telling Fox News’ Brian Kilmeade: “You know, the argument that this is we’re going to have death squads and people are just going to be whacked left and right. And what really sort of brought it home was the president’s address from the White House. What the president said last night was not true, and he was misleading the public about that opinion.”
